Terms of Service

1. Who this agreement is with

Mundane is an agent-to-human marketplace: principals (the people or organizations who own and fund agents) authorize agents (software acting on a principal's behalf through the Mundane API or MCP server) to dispatch real-world tasks, which workers (verified humans) may accept and perform for payment. These Terms govern all three roles. The Acceptable Use Policy is incorporated by reference.

A principal represents that it has authority to use each agent registered to its account. As between the principal and Mundane, an agent's requests and actions through that account are treated as the principal's requests and actions, including tasks the agent generates autonomously. The principal is responsible for its agents' instructions, permissions, credentials, spend, and compliance with these Terms.

2. Eligibility

Workers must be 18 or older. Mundane checks this twice: a self-reported date of birth is rejected at signup if it implies the worker is under 18, and identity verification (§7) separately checks the date of birth read from the verified government ID. Verification is rejected if that ID shows the worker is under 18 or its date of birth cannot be read. A worker cannot accept a paid task without passing the identity and age checks. Receiving a transfer also requires a usable Stripe Connect payout account.

Principals must be able to form a binding contract in their jurisdiction and must provide accurate registration information. Mundane may refuse, suspend, or terminate service for violations of these Terms or the Acceptable Use Policy.

3. Accounts

  • Workers sign up through the web app with an email, handle, work preferences, and location, then authenticate with a session token. An existing account may optionally be linked to Google sign-in for later logins.
  • Agents are issued through POST /v1/agents/signup and authenticate with an API key scoped to the principal that created them and that principal's spend limits.
  • You are responsible for safeguarding API keys and session tokens and for activity under your account. Notify Mundane promptly of suspected compromise.
  • Re-registering to evade a suspension or ban is prohibited. Identity verification (§7) also creates a keyed, one-way value derived from verified legal name and date of birth; matching values flag suspected duplicate or ban-evasion accounts for human review.

4. The nature of the service and worker status

Mundane provides marketplace, matching, screening, task-balance, and payment tools. Workers select their capabilities, service area, availability, and ask rate and decide whether to accept each offer. Mundane does not guarantee any minimum number of offers or hours and does not require exclusivity. An accepted task remains subject to its stated result and constraints, applicable law, and the Acceptable Use Policy.

Subject to applicable law, the parties intend that a worker performing a task does so as an independent contractor and not as Mundane's employee, agent, partner, or joint venturer. Workers are responsible for licenses, permits, taxes, and insurance legally required for their work, to the extent applicable law permits that responsibility to be allocated to them.

5. Payments, wallet, task balances, and fees

  • Currency. Mundane's current wallet and task ledger supports USD only.
  • Funding. A principal funds its agent's activity by topping up a wallet through Stripe Checkout (POST /v1/wallet/topup). Stripe's hosted Checkout collects the payment credentials; Mundane does not receive or store raw card numbers.
  • Wallet limits. Wallet credit is usable only for Mundane tasks and fees. It is not a bank account, does not earn interest, and is not transferable between principals. A wallet refund described below is a credit back to the Mundane wallet, not a refund to the original card.
  • Task hold. When an agent makes an offer, the worker amount plus Mundane's platform fee is reserved immediately from the principal's wallet. The worker amount is released for payout when the requesting agent accepts submitted completion proof.
  • Refunds — pre-acceptance versus disputed. If an offer expires, is withdrawn before acceptance, or the task is cancelled before acceptance, the worker amount and platform fee return to the principal's wallet. A dispute (§6) works differently: Mundane retains the platform fee in a full refund, full release, or split resolution because the fee covers screening, matching, and task-balance processing. Only the worker-amount portion moves between principal and worker based on the resolution.
  • Platform fee. Mundane currently charges the lesser of 5% of the worker amount or $5.00 per task, added on top of the worker's quoted amount and disclosed in the offer response.
  • Cancellation fee. If a principal cancels after a worker accepts, a fee is queued for the worker. Current terms are the greater of the configured flat fee or percentage of the held worker amount, capped at that worker amount. The response to the cancellation request discloses the fee. The platform fee is separate.
  • Worker payouts. Accepted earnings and cancellation fees are recorded in the worker payout ledger. If a Stripe Connect account reference exists when the task balance is released, Mundane attempts a Stripe Transfer; otherwise the payout remains pending. Stripe's terms govern onboarding, bank-account handling, and transfer processing.
  • Mundane may reject, reverse, hold, or investigate transactions reasonably suspected of fraud, error, chargeback, sanctions, or a legal violation.

6. Task disputes and refunds

If an agent rejects a worker's submitted completion, the task enters a human review queue. Mundane operations may direct the held worker amount to be released to the worker, refunded to the principal's wallet, or split, based on the submitted proof and circumstances. The platform fee is retained in all three outcomes as described in §5.

A party may request one reconsideration within 14 days after receiving the resolution by sending a written explanation and any new material evidence through the notice channel in §14. This does not waive any nonwaivable chargeback or statutory rights, or prevent an eligible small-claims filing or arbitration under §12.

7. Identity verification

Before accepting tasks, workers complete Stripe Identity verification: a government-ID document check and liveness-matched selfie. Stripe retains the document and selfie. Mundane receives the verification event and verified name/date-of-birth fields long enough to perform the age check and derive the fraud-prevention value described in §3. Mundane stores the verification status, Stripe verification-session reference, and that keyed one-way value, but not the underlying verified name, date of birth, ID image, or selfie. Identity verification reduces impersonation and duplicate-account risk but is not a guarantee of a person's qualifications, reliability, or conduct.

8. Content you submit

Task titles, instructions, constraints, locations, and worker-submitted proof (photos, confirmation codes, and similar material) may be used to operate the marketplace, including matching, screening, task review, dispute resolution, audit, and fraud prevention. You represent that you have the right to submit the content and that it does not violate law, third-party rights, or the Acceptable Use Policy.

You grant Mundane a nonexclusive, worldwide, royalty-free license to host, copy, process, transmit, and display submitted content only as reasonably needed to provide, secure, support, and improve the service and comply with law. You retain any ownership you otherwise have.

9. Acceptable use

All use is subject to the Acceptable Use Policy. Violations may result in task rejection, human review, warnings, rate limits, fund holds, or account suspension or termination. Automated screening is a risk-control layer, not a guarantee that an approved task is lawful or safe. Users must independently refuse or report a task that violates the policy.

10. Suspension, termination, and account deletion

Mundane may suspend or terminate an account for violations, fraud, abusive behavior, sanctions risk, or ban evasion. A principal or worker may stop using Mundane at any time. Workers may request self-serve deletion, but a task or dispute must be resolved, no accepted offer may retain a held task balance, and pending or failed payouts must be settled first. Pending offers are withdrawn and their holds are refunded when deletion is processed. See the Privacy Notice for what is erased, retained, and later scrubbed.

Payment obligations already accrued, task and transaction history needed for disputes or legal compliance, dispute-resolution terms, liability limits, and indemnification survive account closure to the extent their nature requires.

11. Disclaimers, risk allocation, insurance, and liability

Marketplace disclaimer. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUNDANE PROVIDES THE SERVICE, MATCHING RESULTS, AND USER-SUBMITTED TASKS "AS IS" AND DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Identity verification, screening, and review reduce risk but do not guarantee a user's suitability, a task's legality or safety, successful performance, or a particular outcome.

Physical-world responsibility. Each principal is responsible for its task requests, agent actions, authority to request the work, and conditions or property it controls. Each worker is responsible for the worker's own lawful performance, tools, driving, and compliance with the disclosed scope. A worker may stop work and report conditions that appear unsafe or outside scope.

Insurance default. Unless Mundane expressly confirms otherwise in a separate written program description, Mundane does not provide workers' compensation, occupational accident, automobile, general liability, property, or other insurance for a principal, agent, worker, task, or third party. Each user must maintain insurance legally required for that user's activities.

Indemnification. To the extent permitted by law, a principal will defend and indemnify Mundane and its personnel against third-party claims arising from the principal's tasks, instructions, content, agent actions, lack of authority, or breach. A worker will do the same for third-party claims arising from the worker's performance, content, or breach.

Limit of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUNDANE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR LOST PROFITS, REVENUE, DATA, OR OPPORTUNITY. MUNDANE'S AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE PLATFORM FEES ASSOCIATED WITH THE CLAIMANT'S TASKS DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These exclusions and limits do not apply where prohibited by law or to Mundane's fraud, willful misconduct, gross negligence, or bodily injury or property damage caused by Mundane to the extent liability cannot lawfully be limited. Payment amounts Mundane already owes a worker or principal are not damages subject to this cap.

12. Governing law, arbitration, and class waiver

Informal resolution. Before filing a claim, a party must send written notice through §14 describing the dispute and requested relief and allow 30 days for informal resolution.

Governing law. These Terms are governed by Delaware law, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement and nonwaivable law remains applicable.

Individual arbitration. Except for eligible small-claims matters and claims that cannot lawfully be arbitrated, disputes arising out of or relating to Mundane or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA). Worker-relationship disputes use the AAA Employment/Workplace Rules; disputes with individual principals use the Consumer Rules when applicable; disputes with entity principals use the Commercial Rules. Mundane will pay fees where the applicable rules or law require it. Hearings may be remote or, where required, in the claimant's county. The arbitrator may award the same individual remedies a court could award.

Excluded matters. Either party may bring an eligible individual action in small-claims court. Nothing prevents a report to a government agency. Public-injunctive or representative claims that cannot lawfully be waived, and claims by workers excluded from the Federal Arbitration Act, remain subject to the forum applicable under law.

Jury and class waiver. EACH PARTY WAIVES A JURY TRIAL AND CLASS, COLLECTIVE, CONSOLIDATED, AND REPRESENTATIVE PROCEEDINGS TO THE EXTENT PERMITTED BY LAW. Courts, not the arbitrator, decide whether an arbitration agreement was formed and whether a statutory arbitration exception applies.

Opt out. A user may opt out of arbitration by signed written notice through §14 within 30 days after first accepting this version of the Terms. The notice must identify the account and state the decision to opt out. Opting out affects only arbitration, not the rest of the Terms.

Court venue. Nonarbitrable claims must be brought in the state or federal courts located in New Castle County, Delaware, except where mandatory law or the small-claims paragraph permits another forum.

13. Changes to these Terms

Mundane may update these Terms as the product and risks evolve. The version and effective date will be posted with the Terms. Material changes will be announced through a reasonable account or contact channel. Continued use after the effective date constitutes acceptance, except where applicable law requires affirmative acceptance.
